TERMS & CONDITIONS OF CHARTER
- For confirming a charter, we require 100% advance, based on the indicated flying time, overnight stay, waiting for charges etc.
- Minimum 2 Hrs of flying time will be charged on an everyday basis. The flying/block time quoted in the quotation is approximate and may vary. The final settlement of bills shall be done on actual hours flown, over and above the estimated flying time. (From our base and back to base).
- Crew Layover in case of prolonged halts during a single day at a particular station, the “Charterer” will make suitable arrangements for lodging (at a 5-star hotel), boarding, & local transport or FLY AVCARE Aviation (India) LLP will make the necessary arrangements at an additional cost.
- Above flight timings are indicated in NIL wind conditions and billing would be on actual time taken for the flight “chokes off to chokes on”, depending upon weather/wind, fog/visibility conditions and flight schedules are subject to change / divert due to weather conditions, flight safety and operational restrictions.
- Extension of watch hour charges, if applicable, will be charged on actuals.
- Confirmation of charter to uncontrolled airstrips should be given 12 working hrs from the
departure time.
- PAYMENT TERMS Flight will be treated confirmed only after receiving a 100 % advance deposit by Cheque/DDin favour of FLY AVCARE AVIATION (India) LLP. orthrough RTGS/NEFT to our account.

- In the case of foreign passengers, we require Names, Nationality, Passport No., Date of issue and Date of expiry of the passport of passengerstravelling, well in advance to obtain prior permissions.
- Please send us the payment and acceptance of our offer on the above-mentioned terms, by signing and returning this document and a copy of the quotation / Proforma Invoice given to you.
- We must receive the requested information within the stipulated timelines to enable us to seek the necessary permissions for the execution of the flight.
- We do notserve alcoholic beverages on board (for flights within India) and smoking is not allowed on-board the aircraft.
- Standard Catering is included in the quotation. Any special request would be charged at an additional cost. We ensure all catering is arranged through reputed vendors. FLY AVCARE Aviation (India) should not be held responsible for the quality & quantity of food ordered through thirdparty vendors.
- Airport ground transportation would be provided as per the availability. In case of special requests, additional charges would be borne by the charterer. FLY AVCARE Aviation (India) LLP would assist in seeking permissions. However, this would be entirely dependent on Airport Rules & Regulations.
- Baggage limitations applicable as per selected aircraft. The final decision to load/unload baggage during a flight would entirely be the captain’s decision operating the aircraft.
- All Government taxes & levies will be paid by the customer. GST @ 18.00 % or as applicable will be applicable on all the charges.
- CANCELLATION:
In case of cancellation.
- 100% of the charter costshall be deducted if the flightis cancelled lessthan 7 days before
the scheduled departure.
FORCE MAJURE Operator does not hold itself responsible for non-operation of the charter for any unforeseen reason/s such as (1) Bad Weather (2) Poor Visibility (3) Non–Availability of clearances from ATC / Defense Authorities / Civil Administration (4) Technical Problem: – if due to above reasons, the flight cannot take off from the originating station full amount will be refunded.
50% of the charter cost if the flightis cancelled between 8 to 15 ofscheduled departure.
- An amount of Rs. 2,50,000 will be levied against flight preparation charges if is cancelled due to “Force Majeure” reasons.
- We always obtain the destination weather before departure. However, if due to sudden deterioration of weather en-route/destination, the aircraft cannot land at the Destination and must return to the starting point or divert to some other airport, the actual flying time would be chargeable and balance if any, would be payable/refundable.
- FLY AVCARE Aviation (India) LLP is not responsible for any technical snag that develops in the aircraft which cannot be rectified within the time limit and affect the operation of the flight.
